Décret n° 99-240 du 24 mars 1999 relatif aux conditions de commercialisation de certains objets ayant l'apparence d'une arme à feu
The Prime Minister,
On the report of the Minister of Justice, the Minister of the Interior, the Minister of Defense and the Minister of the Economy, Finance and Industry.
Having regard to Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 laying down technical standards and regulations, and to the letter received by the Commission of the European Communities on 28 May 1997 in which the French Government referred the matter to the said Commission:
Having regard to the French Penal Code, in particular articles 121-2, 121-41 and R.610-1 thereof
Having regard to the French Consumer Code, in particular article L.221-3
Having regard to the opinion of the Consumer Safety Commission dated July 2, 1997;
The Conseil d'Etat (Finance Section) having been heard,
Decree:
Art.1er - The offering, sale, distribution free of charge or provision free of charge of new or second-hand objects having the appearance of a firearm, intended to launch rigid projectiles, when they develop an energy at the muzzle greater than 0.08 joules and less than 2 joules, are regulated under the conditions defined by the present decree.
Art.2 - The sale, distribution free of charge to minors or making available for a fee or free of charge of the products referred to in article 1 of the present decree are prohibited.
Art.3 - An indication of the energy in joules developed by the products referred to in article 1 of the present decree must appear on the product, its packaging and the enclosed instructions for use.
Art.4 - The packaging and instructions for use of the products referred to in article 1 of the present decree must indicate in legible, visible and indelible characters the two following statements:
"Distribution forbidden to minors" and "Warning: never aim the shot at a person".
Art.5 - The following are punishable by the fine laid down for 5th class offences:
1° Selling, distributing free of charge to minors, or making available to them free of charge or for a consideration, the products referred to in article 1 of this decree;
2° Offering for sale, offering for sale, selling or distributing free of charge or for a consideration, the products referred to in article 1 of this decree, in disregard of the provisions of articles 3 and 4 of this decree.
In the event of a repeat offence, the fine laid down for the repeat offence of a 5th class contravention is applicable.
Legal entities may be declared criminally liable, under the conditions laid down in article 131-41 of the same code.
Art.6 - The Minister of Justice, the Minister of the Interior, the Minister of the Economy, Finance and Industry, the Minister of Defense, the Secretary of State for Small and Medium-sized Enterprises, Trade and Craft Industries and the Secretary of State for Industry are each responsible for the execution of this decree, which will be published in the Journal Officiel de la République Française.
